NOTICE OF REVISED AMENDMENTS TO LOCAL RULES OF PRACTICE AND PROCEDURE FOR THE GENERAL DIVISION OF THE MONTGOMERY COUNTY COURT OF COMMON PLEAS

AMENDMENTS TO LOC. RULE 2.35, ARBITRATION EFFECTIVE JANUARY 1, 2004

Original proposed amendments to Loc. R. 2.35, Arbitration, were published for a sixty-day public comment period ending April 14, 2003. After consideration of comments received, the Court has adopted the following amendments to the Local Rules of Practice and Procedure of the Montgomery County Court of Common Pleas, General Division, effective January 1, 2004.

SECTION IX:

IX TRANSCRIPTION OF ARBITRATION PROCEEDINGS

A. There shall be no recording or transcription of arbitration proceedings by stenography or other methods except upon a motion to the court for good cause shown or upon agreement of all parties.

B. If the court grants a motion to record or take transcription during an arbitration hearing, the requesting party shall cause a record to be made and shall pay the expenses, which shall not be considered costs in the case.

C. If a party desires a copy of a prepared transcript, the party shall contact the preparer of the transcript and a transcript will be provided upon the payment of a fee. Fees for copies of prepared transcripts in arbitration cases shall be based upon the usual charges for copies of depositions.
